"A. Facts:

Defendant appealed a judgment of the Circuit Court of Prince William (Virginia), which convicted defendant of attempted capital murder. Defendant maintained that the trial court erred in refusing and failing to give the jury an instruction on the elements of simple assault, with a specific instruction on intent to assault so as to effect an escape.

  • A charge of attempted capital murder requires proof of both a specific intent to kill the victim and an overt but ineffectual act committed in furtherance of the criminal purpose. Criminal assault, however, is any attempt or offer with force or violence to do corporal hurt to another. It is a lesser included offense of attempted murder.
  • The requirement of noting an exception to a final adverse ruling of the trial judge is eliminated.
