"A. Any
person who commits a simple assault or assault and battery is guilty of a Class

or national origin, the penalty upon conviction shall include a term of
confinement of at least six months, 30 days of which shall be a mandatory

The Virginia
Court made the following holding:
- An appellate court must
consider the evidence and all reasonable inferences fairly deducible
therefrom in the light most favorable to the Commonwealth, as the
prevailing party below. That standard requires the appellate court to
regard as true all the credible evidence favorable to the Commonwealth and
all fair inferences to be drawn therefrom.
- When considering the
sufficiency of the evidence on appeal, a reviewing court does not ask
itself whether it believes that the evidence at the trial established
guilt beyond a reasonable doubt. Viewing the evidence in the light most favorable
to the Commonwealth, as the appellate court must when it was the
prevailing party in the trial court, it must instead ask whether any
rational trier of fact could have found the essential elements of the
crime beyond a reasonable doubt. This familiar standard gives full play to
the responsibility of the trier of fact fairly to resolve conflicts in the
testimony, to weigh the evidence, and to draw reasonable inferences from
basic facts to ultimate facts.
