Court made the following holding:
- A reviewing court's
responsibility in reviewing jury instructions is to see that the law has
been clearly stated and that the instructions cover all issues which the
evidence fairly raises. In making this determination, appellate courts
view the evidence with respect to the refused instruction in the light
most favorable to the appellant. Where credible evidence in the record
supports a proffered instruction, failure to give the instruction is
reversible error. However, an instruction should not be given when there
is no evidence tending to prove the facts upon which the instruction is
based, for the reason that the tendency of such instruction is to mislead
the jury by withdrawing their attention from the legitimate points
involved in the issue.
- An assault occurs when
an assailant engages in an overt act intended to inflict bodily harm and
has the present ability to inflict such harm or engages in an overt act
intended to place the victim in fear or apprehension of bodily harm and
creates such reasonable fear or apprehension in the victim.
